Terms of Service

Heather Campins Jewelry
A DBA of Coastal Stack, LLC

Overview

This website is operated by Heather Campins Jewelry, a DBA of Coastal Stack, LLC (“Heather Campins Jewelry,” “we,” “us,” or “our”).

Heather Campins Jewelry offers this website, including the information, features, tools, products, and services available through it (collectively, the “Services”), subject to these Terms of Service (“Terms”).

Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to offer products and services to you.

By accessing our website, using the Services, or placing an order, you agree to these Terms and to the policies referenced herein, including our Privacy Policy, Returns & Refunds Policy, Shipping Policy, and, when applicable, Custom Design Policy.

Please read these Terms carefully before using the Services.

1. Online Store Terms

By using the Services, you represent that you are legally permitted to enter into transactions through the website or are using the website with the appropriate consent of a parent or legal guardian.

You may not use our products, website, or Services for any illegal or unauthorized purpose or violate applicable laws in connection with your use of the Services.

You must not transmit viruses, malicious code, or other materials intended to interfere with the operation or security of the website or Services.

2. Products and Services

We make reasonable efforts to describe and represent our jewelry accurately.

Because jewelry may incorporate natural or laboratory-grown gemstones, diamonds, precious metals, handmade elements, individually selected stones, or other materials, reasonable variations may occur.

Natural gemstones in particular may vary in color, tone, clarity, inclusions, pattern, cut, and other characteristics. Such natural variations are not necessarily defects.

Product availability may change without notice.

3. Product Images and Representations

We make reasonable efforts to provide useful and accurate product imagery.

Images displayed through the Services may include product photography, manufacturer or designer imagery, CAD renderings, digital representations, enlarged detail views, or other visual representations intended to illustrate a product or design.

Screen settings, lighting, photography, scale, gemstone characteristics, production differences, and other factors may affect the appearance of an item.

Images should therefore be considered representations of the product rather than guarantees that every visual characteristic will appear exactly the same in person.

For custom-design projects, additional provisions concerning CAD renderings and finished appearance are contained in our Custom Design Policy.

4. Pricing

Prices are displayed in U.S. dollars unless otherwise stated and are subject to change before an order is accepted.

Precious-metal prices, gemstone prices, availability, and other costs associated with fine jewelry can change over time.

Although we make reasonable efforts to maintain accurate pricing and product information, typographical, technical, data-entry, or other errors may occasionally occur.

If an item is listed at an incorrect price or with materially incorrect information, we reserve the right to correct the error.

If an affected order cannot be fulfilled as presented, we may contact you regarding available options or cancel the affected order and refund any applicable amount paid.

5. Orders and Availability

Submitting an order does not necessarily constitute final acceptance of the order.

We reserve the right to decline, limit, or cancel an order when reasonably necessary because of suspected fraud, payment issues, material pricing or listing errors, product or material unavailability, shipping limitations, inability to fulfill requested specifications, or other legitimate business reasons.

If we cancel an order after payment has been collected, the applicable amount will be refunded.

Gemstones, settings, metals, sizes, components, and other materials displayed or discussed may become unavailable.

If a material component of your order becomes unavailable, we may contact you to discuss an appropriate alternative or cancellation and refund of the affected item.

6. Order Information

You agree to provide current, complete, and accurate purchase, billing, shipping, and contact information.

Please promptly notify us if information relating to an order needs to be corrected.

We may take reasonable measures to verify customer, payment, billing, or shipping information, particularly for higher-value transactions or when necessary for fraud prevention.

7. Order Changes and Cancellations

If you need to change or cancel an order, please contact us as soon as possible.

Orders may generally be changed or cancelled until the order has been processed.

Once an order has been processed, cancellation or modification may no longer be possible because resources, materials, or services may already have been committed to the order.

Custom, personalized, engraved, sized, or specially ordered merchandise may be subject to additional terms disclosed before purchase or contained in our Custom Design Policy.

8. Custom and Made-to-Order Jewelry

Custom-designed, personalized, engraved, sized, made-to-order, and specially ordered jewelry may be subject to additional terms because work, materials, or services may be committed specifically to an individual order.

Custom-design projects are governed by our Custom Design Policy in addition to these Terms.

Where the Custom Design Policy contains a provision specifically applicable to a custom-design project, that more specific provision will apply to the project.

9. Returns, Refunds, and Exchanges

Returns, refunds, and exchanges are governed by our Returns & Refunds Policy.

Certain custom-designed, personalized, engraved, altered, specially ordered, or otherwise customized items may be final sale as disclosed before purchase or provided in our Custom Design Policy.

Nothing in these Terms is intended to eliminate rights or remedies that cannot lawfully be waived.

10. Shipping and Delivery

Shipping and delivery are governed by our Shipping Policy.

Heather Campins Jewelry currently ships merchandise only to eligible addresses within the United States.

Processing and production times vary by piece. Any applicable estimated timeframe will be provided through the product listing, checkout process, order communications, or custom-design process when reasonably possible.

11. Personal Information

Our collection, use, processing, and disclosure of personal information are governed by our Privacy Policy.

Our store is hosted through Shopify, which processes certain information in connection with your access to and use of the Services.

12. Intellectual Property

The website and its original content, including Heather Campins Jewelry and Coastal Stack, LLC branding, logos, text, graphics, photographs, designs, and other materials created or owned by us, are protected by applicable intellectual-property laws.

Third-party materials remain the property of their respective owners.

You may not reproduce, distribute, sell, commercially exploit, or create unauthorized derivative works from protected materials except as permitted by law or with appropriate authorization.

13. Custom Designs and CAD Materials

Custom-design concepts, CAD files, technical drawings, renderings, production files, and other design-development materials are subject to the intellectual-property provisions contained in our Custom Design Policy.

Purchase of a finished piece of jewelry does not automatically transfer ownership of underlying CAD files, drawings, renderings, production files, or other design materials unless expressly agreed in writing.

14. Client and User Submissions

If you submit reviews, comments, photographs, custom-design materials, inspiration images, suggestions, or other content to us, you represent that you have the right to provide that material for the purpose for which it is submitted.

You may not submit unlawful, fraudulent, defamatory, malicious, infringing, or otherwise prohibited material.

Custom-design materials and inspiration images are also subject to our Custom Design Policy and Privacy Policy.

15. Third-Party Services and Links

The Services may use, integrate with, or provide links to services operated by third parties, including Shopify, payment providers, shipping carriers, social-media platforms, analytics providers, and other service providers.

We are not responsible for the content, availability, privacy practices, security, or independent actions of third-party websites or services that we do not control.

Your use of third-party services may also be subject to their respective terms and privacy policies.

16. Errors, Inaccuracies, and Omissions

Occasionally, information available through the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, specifications, pricing, promotions, shipping charges, estimated timing, or availability.

We reserve the right to correct errors or inaccuracies and update information when reasonably necessary.

If a material error affects an order you have already submitted, we may contact you regarding the correction and available options or cancel and refund the affected order when appropriate.

17. Prohibited Uses

You may not use the website or Services:

  • For an unlawful or fraudulent purpose;
  • To violate applicable laws or regulations;
  • To infringe our intellectual-property rights or the rights of another person;
  • To submit false, misleading, abusive, defamatory, or unlawful information;
  • To upload or transmit viruses, malicious code, or other harmful technology;
  • To improperly collect or track personal information belonging to others;
  • To spam, phish, scrape, crawl, or otherwise misuse the Services;
  • To interfere with or circumvent website or account security; or
  • In any manner that materially interferes with the operation of the Services.

We reserve the right to restrict or terminate access to the Services for violations of these Terms.

18. Disclaimer of Warranties

We make reasonable efforts to provide accurate information and reliable Services, but we do not guarantee that access to the website will always be uninterrupted, timely, secure, or error-free.

To the extent permitted by applicable law, the website and Services are provided on an “as is” and “as available” basis except for warranties or representations expressly provided by us or rights that cannot lawfully be excluded.

Nothing in these Terms is intended to disclaim or limit any warranty, right, or remedy that cannot legally be disclaimed or limited.

19. Limitation of Liability

To the maximum extent permitted by applicable law, Heather Campins Jewelry, Coastal Stack, LLC, and their applicable owners, officers, employees, agents, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, punitive, or consequential damages arising from your use of the website or Services.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Heather Campins Jewelry, Coastal Stack, LLC, and their applicable owners, officers, employees, agents, contractors, and service providers from third-party claims arising from your material violation of these Terms, applicable law, or the rights of another person.

21. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary.

The remaining provisions will continue in full force and effect.

22. No Waiver

Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.

23. Entire Agreement

These Terms, together with the policies and other terms incorporated by reference, constitute the agreement between you and us regarding your use of the Services and applicable transactions.

They supersede prior versions of these Terms concerning the same subject matter.

24. Governing Law

These Terms and transactions with Heather Campins Jewelry are governed by and construed in accordance with the laws of the State of Florida and applicable federal law, without regard to conflict-of-law principles, except where applicable law requires otherwise.

25. Changes to These Terms

We may update these Terms periodically to reflect changes to our Services, business practices, or legal requirements.

The current version will be posted on this website with an updated “Last updated” date.

The Terms applicable to a transaction will generally be those in effect when the applicable order was placed, except where a change is required by law or otherwise agreed.
